In the information, he was charged with being an accessory to the death of one Harold Bechtelheimer, a highway patrolman, by the hand of one Valenzuela. Since the defendant neither testified, nor offered evidence in his own behalf, the factual situation presents no material conflict; however, we believe that a brief summation thereof should be set out in this opinion.
